The U.S. Military is exempt from many important environmental and public
safety laws. It is exempt from the Oil Pollution Act of 1990, the
Noise Act, important planning and disclosure elements of nuclear safety
laws, and from almost any meaningful enforcement of most laws. The
military’s “sovereign immunity” prevents any enforcement action by U.S.
EPA or other agencies unless Congress specifically waives immunity and
grants the agency enforcement authority.
Impacts from unregulated military projects mean that communities neighboring
military bases have less environmental protection than other communities
just because they host the U.S. Military. Even when laws do apply
to the military, regulators have little or no ability to assess fines,
shut down polluting operations, or otherwise enforce compliance.
Until the military has to follow the same laws as the rest of us, our health
and safety and our environment will be at increased risk from military
pollution.
The Military Environmental Responsibility Act (MERA) is a bill proposed
by San Diego Congressman Bob Filner which would remove all Military exemptions
from our state and federal environmental laws. The MERA would bring
military operations under the same environmental regulations as private
businesses and private citizens. |
